Juvenile Competency Assessments

A juvenile competency evaluation assesses whether a minor involved in the legal system possesses a rational and factual understanding of the court proceedings against them, and whether they can effectively assist their defense attorney.

Unlike adult competency, which often focuses heavily on severe mental illness, juvenile competency must closely consider developmental immaturity. A youth’s brain is still growing, and factors like age, cognitive delays, trauma, or learning disabilities can significantly impact their capacity to understand the legal process.

When is an Evaluation Necessary?

An attorney, judge, or parent may request a competency evaluation if there are concerns that a youth cannot actively participate in their own defense. Common red flags include:

• An inability to understand the charges, possible consequences, or the roles of court personnel (like the judge, prosecutor, or defense attorney).

• Developmental delays, intellectual disabilities, or low cognitive functioning.

• Pervasive mental health symptoms (such as extreme anxiety, psychosis, or severe depression) that impair reality testing or concentration.

• Significant histories of trauma or neurodevelopmental disorders (like ADHD or Autism Spectrum Disorder) that interfere with communication and decision-making

Our Forensic Evaluation Process

We approach juvenile evaluations with rigor, objectivity, and a developmental lens, ensuring all legal requirements are thoroughly satisfied.

1. Consultation & Record Review: Phase 1

   We begin by reviewing all relevant documentation. This includes legal discovery, police reports, school records (IEPs or 504 plans), and past psychological or medical evaluations to build a comprehensive history

2. Clinical & Forensic Interviews: Phase 2

   We conduct face-to-face interviews with the youth using developmentally appropriate, evidence-based forensic tools. This includes utilizing the Juvenile Adjudicative Competence Interview (JACI), a semi-structured instrument specifically designed to assess a minor's understanding of the legal system, their role in the proceedings, and their ability to assist counsel. We also interview parents or guardians to gather essential developmental, medical, and behavioral background.

3. Mental Health Testing: Phase 3

   When indicated, we administer specialized psychological, cognitive, or achievement tests. These objective measures complement the JACI by evaluating the youth's intellectual functioning, memory, and mental health status, helping us determine if any deficits are due to developmental immaturity, mental illness, or cognitive delays.

4. Comprehensive Report and Recommendations: Phase 4

   We deliver a meticulous, legally defensible forensic report. If the youth is found incompetent, we provide explicit, actionable recommendations for competency restoration services to help them gain the necessary legal understanding.
